COLEMAN-BAKER ACT REQUEST

O.C.G.A. § 17-21-3(e)(1)

    The Coleman-Baker Act, passed by the Georgia General Assembly, went into effect on July 01, 2023. The Act aims to bring justice and closure to many Georgia families affected by unsolved homicides, ensuring that answers are accessible to those who desperately seek them. The Spalding County Sheriff's Office is dedicated to helping those affected by these tragedies by bringing closure when possible.

To make this request, the case must meet the following requirements:

 - The crime is a murder as defined by § O.C.G.A. 16-5-1.

 - The murder must have occurred on, or after, January 1, 1970.

 - The murder occurred at least three (3) years prior to the date of the application.

 - The Spalding County Sheriff's Office was the original investigating agency.

 - All probative leads have been exhausted or no likely perpetrator has been identified.

 - The applicant is a designated person as defined in the Coleman-Baker Act*.

 - All of the application's required information is true and complete.

If an application does not meet the above criteria, the Spalding County Sheriff's Office may not accept the application under the provisions of the Act.  If you believe your application meets all the required criteria, a request form can be submitted.

* A designated person is a parent, parent-in-law, grandparent, grandparent in-law, sibling, spouse, child, stepchild of a victim, any person who exercised in loco parentis control over a victim under the age of 18 years old, or their designated attorney in good standing with the State Bar of Georgia.
